1. Definitions

• 1.1 Fiore Di Puglia S..p.A": the company aiming to carry out by the Internet the sale of alimentary and non-alimentary products belonging to its assortment.
• 1.2 "Products": all the products and/or goods which are merchandised by the company Fiore Di Puglia and belong to its own assortment.
• 1.3 "Customer": he is the goods buyer, i.e. the consumer, that is to say the natural and legal person buying a product with a purpose not related to the commercial or professional activity which he probably carries out.
• 1.4 "Site": it is composed by Web page relevant to www.fioredipugliaspa.it.
• 1.5 "Charge": it is the buying order forecasting a product delivery within those days following the date of the order transmission from the Customer to the company Fiore Di Puglia.
• 1.6 “Our suggestions”: they are special-wrapped single products or series of products proposed during a specific time-lapse.

 

2. Application field – results

• 2.1 General terms are an integral part of any proposal, buying order and confirmation of buying order relevant to the goods merchandised by the company Fiore Di Puglia in force as on the related order.
• 2.2 General Terms involve exclusively the sale in favour of a Customer-consumer, as previously explained.

3. Contract formalization

• 3.1 All contracts are clinched exclusively by means of the Customer access to the web site, feasible thanks to the technology of the off-communication on the Internet.
• 3.2All buying orders forwarded to the company Fiore Di Puglia have to be correctly filled in all their items and have to contain all necessary information for the precise identification of the ordered Products, of the Customer and of the delivery place of the Products.
• 3.3 "Customer": he is the goods buyer, i.e. the consumer, that is to say the natural and legal person buying a product with a purpose not related to the commercial or professional activity which he probably carries out.

4. Delivery times and procedures

• 4.1 The company Fiore Di Puglia. takes care of the delivery to the Customers of the Products he/she selected and ordered according to the procedures described in the previous article, by means of couriers and/or reliable forwarding agents.
• 4.2 The goods are delivered to the address provided at the moment of the order which can be different from the customer’s one.
• 4.3 Anyway, delivery times do not overcome 30 days as from the day after the transmission of the order to the company Fiore Di Puglia according to article 6 of the Governmental Decree number 185/1999.
• 4.4 The Customer who would like to modify the delivery address of the goods after having forwarded the order, can contact the Customer Service under the session Contact us by e-mail and ask for the change: your demand will be met if the order has not been attended to, yet.
• 4.5 The Customer will bear the delivery costs.
• 4.6 The products delivery is subordinated to the payment of the relevant price made by the Customer according to one of the payment modes put at the client’s disposal by the company Fiore Di Puglia.
• 4.7 Conditions and terms of delivery other than those provided in the General Conditions must be agreed in advance between the Client and Fiore di Puglia and accepted in writing by the latter.

 

5. Prices

• 5.1 All sales prices of the products reported on the site are expressed in euros.
• 5.2 The prices of the Products include VAT and all other taxes unless otherwise instructed.
• 5.3 Prices of single products, reported on the site from time to time, erase and replace the previous ones.
• 5.4 The applied prices are those shown on the site at the moment of the Customer’s buying order.

 

6. Fiore di Puglia responsibilities

• 6.1 The company Fiore Di Puglia does not take any responsibility further to the usage of the bought products by the Customer. Should the goods be “faulty” the only charge of the Company Fiore Di Puglia will be to take care of its replacement. In no event the company Fiore Di Puglia will be considered responsible for the Customer’s loss of profits.
• 6.2 The company Fiore Di Puglia does not take any responsibility further to inefficiency for reasons beyond its control in any shape or nature, in the event that it cannot enforce the contract within the established time-lapse. As an example, which is not exhaustive, reasons beyond one’s control are provisions of the Public Authority, strike (general and not) of company employees or carriers the company Fiore Di Puglia avails itself of, as well as any other circumstance which is beyond the company control.

 

7. Customer’s obligations

• 7.1 After the conclusion of the online purchase procedure, the Customer undertakes to take care of the printing and the keeping of these General Terms
• 7.2 The information contained by the General Terms have to be read and accepted by the Customer before the forwarding of the buying order, in order to satisfy fully the term established by the articles 3 and 4 of the Governmental Decree number 185/1999. The acceptance occurs by marking the proper space on the web site. Failing that, the order cannot be carried out.

 

8. Withdrawal right

• 8.1The Customer who would like to cancel the forwarded order, can contact the Customer Service under the session Contact us by e-mail and require its cancellation: the request will be accepted if the order has not been attended to, yet.
• 8.2 According to article 5 of the Governmental Decree number 185/1999, the Customer who for any reasons is not satisfied with the purchased product, can back out of the drawn up contract and return the ordered products, even if they have already been delivered, without any penalty and without specifying the reason.
• 8.3 The withdrawal right has to be exerted by the Customer, on penalty of lapse, by sending a registered letter to the company Fiore Di Puglia S.p.A., S.P. 231 km 35+500, 70033 Corato (BA), Customer Service Office, within 5 working days after the receipt of the products.
• 8.4 The above-mentioned communication can be forwarded within the same time-lapse also by telegram or fax 080/8982530, provided that it is confirmed by a registered letter within 48 hours after the forwarding of the telegram or fax.
• 8.5 If the withdrawal is carried out in deference to the above-mentioned conditions, the amount paid for the Product and for the delivery costs is credited to the buyer, who can choose the terms of payment between the following ones:
  a) bank transfer to his/her own account;
  b) bank cheque.
• 8.6 The reimbursement is free and will be carried out in the shortest time possible, and in any case, within 30 days after the date on which the company Fiore Di Puglia gets acquainted with the exertion of the withdrawal right by the Customer.
  

9 Goods guarantee

• 9.1 The Customer buying goods by the company Fiore Di Puglia has the right to return the purchased products and require their replacement if during the transportation damaging or seal breaking have occurred. This right has to be exerted by the Customer no later than 2 days after the receipt of the package, on penalty of lapse, by contacting the company Fiore di Puglia as explained at point 13.2., and taking note of the products damage on the invoice that shall be handed to the client on the moment of delivery of the products.

 

10. Modes of payment

• 10.1 The Customer can pay the ordered goods by Credit card.
• 10.1.1 Payment by credit card takes place through a direct connection with Postepay PayPal, that places an easy usage system at disposalensuring, at the same time, a total safety guarantee of the payments. The bank connections, used for payments by credict card, take place in a safe environment and allow more safety compared to a normal daily use. The system allows the card holder to submit personal information directly to the bank and not to the online shop. Fiore di Puglia does not receive any information regarding the credit card that is only communicated to Postepay Paypal, offering the best guarantee to the buyer.

 

11. Disputes

• 11.1 Any dispute arising from the application, execution, interpretation and violation of the on line contract drawn up by the Customer with the company Fiore di Puglia, is subjected to the Italian jurisdiction.
• 11.2 Further to any controversy between the involved parties, the competent body is the Law Court in Trani.

 

12. Enforceable law and returning

• 12.1 The contracts drawn up by the Customer on line with the company Fiore di Puglia are regulated by the Italian Law.
• 12.2 Even if not expressly fixed in these pages, the valid laws are the ones applicable to the relations and to the case in point provided for by the contract drawn up by the Customer on line with the company Fiore di Puglia. According to the articles 1341 and 1342 of the Civil Code, the Customer declares he read carefully and accepted expressly and notably the following clauses of the Sale General Terms of the company Fiore Di Puglia: 6.
